Helping You Navigate The Complexities Of Your Case

Your Partner in Indiana Appeals

Even judges and juries sometimes make errors. If a jury finds you guilty, a family law court unfairly divides your marital property, or a civil court rules against you, you have the right to appeal the decision. At Fugate Gangstad Lowe LLC, we know what it takes to win on appeal. With the experience to navigate the appellate procedural rules and the knowledge to offer concise, thoughtful arguments on your behalf, we give people in Indiana another chance at achieving their desired outcome in a legal matter.

The Types Of Appeals Our Firm Takes On

At our firm, we help people appeal court decisions in multiple legal areas, including:

  • Criminal law
  • Civil law
  • Family law

No matter what kind of appeal you’re seeking, our considerable skill and experience could help you be successful.

About Our Appellate Lawyer

Attorney Anne Lowe handles all the appellate cases that come through our firm. During her career, she has worked on dozens of appeals while working as a judicial clerk for the Honorable Paul D. Mathias of the Indiana Court of Appeals. It was here she learned the art of meticulous, thorough research and crisp, compelling legal analysis. She has also successfully handled numerous appeals in private practice. Anne spent the years following her clerkship as a trial and appellate litigator, handling cases ranging from auto accident matters to misdemeanor and felony criminal appeals to complex civil appeals before the Indiana Supreme Court. Every year since 2017, Anne has been recognized on the Super Lawyers Rising Stars list.

The Value Our Firm Provides In Appellate Cases

As your appellate lawyer, Anne will analyze the trial record to pinpoint the strongest legal arguments to raise in your appeal, research and draft an appellate brief, take care of filings with the appellate clerk and present a powerful oral argument. If you’re appealing a past criminal conviction, Anne will scrutinize every aspect of the trial record in search of potential grounds for an appeal of your conviction and/or sentence. If it’s a civil matter, whether you seek to overturn a ruling against you or defend a favorable ruling, Anne will carefully examine your case to determine the most effective legal strategy for success on appeal. Finally, decisions in family court aren’t just about dollars and cents – they’re also about time with children and resources to support those children. Whether you want to challenge an adverse ruling or uphold an advantageous one, Anne will advocate for a fair resolution of your family law matters.

Supporting Other Attorneys In Appellate Matters

Appellate work is a niche practice and, often, trial attorneys have neither the time nor the inclination to handle this type of work. That’s where Anne comes in. She is available as a consultant or as co-counsel to give you as much or as little assistance as you need to take on your client’s appeal. In addition to representation before Indiana’s appellate courts, Anne also assists trial attorneys with major substantive motions and with the identification of potential appellate challenges during trial litigation.

Our Successes In Appellate Cases

Anne has established a successful track record in appellate cases. She helped successfully defend in the Indiana Court of Appeals an order denying a summary judgment in the case of Cmty. Health Network, Inc. v. McKenzie, 150 N.E.3d 1026 (Ind. Ct. App. 2020). She helped achieve a reversal by the Indiana Court of Appeals and Indiana Supreme Court of a dismissal order in the case of Bellwether Props., LLC v. Duke Energy Ind., Inc., 87 N.E.3d 462 (Ind. 2017). She achieved the partial reversal by the Indiana Court of Appeals of a summary judgment order in Payne v. Carmel Physician Surgery Ctr., LLC, No. 18A-CT-1391, 2019 Ind. App. Unpub. (Ct. App. Feb. 26, 2019). She, with co-counsel, submitted an amicus brief to the Indiana Court of Appeals on behalf of the Indiana Trial Lawyers Association in connection with the successful appeal, Cox v. Evansville Police Dep’t, 107 N.E.3d 453 (Ind. 2018). Finally, she has been appointed by the Public Defender of Indiana as an appellant’s counsel in numerous appeals of criminal convictions and sentences from across the state.
